Deciding how to proceed after an incident is a process that unfolds over time.  Some members of the community, including Mandated Reporters, are required to report any suspected or known instance of sex discrimination or sex-based harassment to the Title IX Coordinator.

One common misconception about the reporting process is that making a report will automatically lead to an investigation, hearing and/or disciplinary action.  The Title IX Coordinator will review the allegations to determine all available options for resolution.

Making a report is the act of notifying the Title IX Coordinator of an incident of sex discrimination or sex-based harassment.  A report may be accompanied by a request for: supportive measures and resources, no further action, informal resolution, and/or to initiate a formal resolution process.

College Resolution Processes

Some forms of sex discrimination or sex-based harassment may be resolved through an informal resolution process. The Title IX Coordinator or designee will work with the complainant to determine whether there is an appropriate facilitated informal resolution mechanism that may be considered. Informal resolution may include facilitated conversation, training and education for individuals or groups, and/or any other remedy reasonably available.

Formal Grievance Process

When the respondent is a member of the Lafayette community, the College may initiate adjudication proceedings. Because the relationship of students, staff, and faculty to the College differ, the internal investigative process that applies may differ as well. However, each of the procedures is guided by the principles of fundamental fairness and respect for all parties and include the following: notice, an equitable opportunity to be heard, and an equitable opportunity to respond.

These procedures are internal administrative procedures of the College meant to determine whether or not a Lafayette College policy was violated.

Criminal Process

Lafayette College also encourages complainants to consider pursuing criminal action for incidents of sex-based harassment that may also be crimes under Pennsylvania law. Lafayette College will assist a complainant, at their request, with contacting the appropriate law enforcement agency.

Mandated Reporters

A Mandated Reporter is an employee of the College who is obligated by policy to share knowledge, notice, and/or reports of sex discrimination or sex-based harassment, and/or retaliation with the Title IX Coordinator or a Deputy Coordinator.
